Concern over new downloading laws

Concern over new downloading laws - New Zealand's source for technology news on Stuff.co.nz

On February 28, a new section of the Copyright (New Technologies) Amendment Act 2008 will come into force.

It says internet service providers (ISPs) must "reasonably implement a policy that provides for termination, in appropriate circumstances, of the account with that internet service provider ...

Lol this is gonna be stupid,

Lol this is gonna be stupid, normally when you sign up to an ISP your on contract.. you want out. you gotta pay.. you think people gonna pay?? haha I don't think so.
I could go to a school or library and download a song.. Ohh no the schools in trouble now. no internet... Even so if you want to get cheap in nasty. go to a Cyber cafe an download music
FTP!!!

What happens if it is a legal

What happens if it is a legal context but they still stop your internet! Plus all the internet companies arent going to like it - people wont need so much internet (I mean reason why people get high GB internet is to download things legally and illgally) So to make sure they get enough money they will probably make the internet go up. The whole idea is stupid! Made by stupid people.
- I do understand that it is hurting a lot of people from people downloading illegal context but a reason why some people do it is because things are so expensive. Why not make things(ie software) cheaper SOME people might stop downloading.

I use my bandwidth to *buy*

I use my bandwidth to *buy* content... and to download much free stuff, like dist-upgrades. I also share my wifi with folks waiting for the bus, (except smtp) but am considering turning this off.

They can charge what they want for their content, and they have a right to have their works protected.

This law isn't going to make people buy more because most of what is being downloaded illegally is tv episodes that you couldn't buy in New Zealand if you wanted to.

Instead it'll mean real harm to new zealanders when the next idiot working for random company decides they own something (like linux, or 5 words quoted that Obama said, or the structure of a standard privacy policy) and then causes real harm with an accusation against a competitor.

what are they going to do

what are they going to do about internet cafes. they are going to put people out of business.

internet cafes are a very

internet cafes are a very important part of our tourism industry.

They can become downstream ISPs (i hope) and terminate accounts when they get an accusation -- but truly an internet cafe should never be allowed to snoop on your activity as you check emails while travelling -- and i'm glad our laws say they cannot.

The law remains unworkable, and doesn't protect creative industries, as many artists have said.

Everything has a funny side

Everything has a funny side and what I think is the funny side of all this, is that if someone accuses MPs in parliment of downloading the stuff they are not allowed to, (like all bussiness there are always people that will try and downlaod or watch porn etc) and within a short time with no evidence we could all shut parliment down and those who have imposed this rediculous law.

My theory what goes around, comes around eh guys :o).

Food for thought: Why stop their why not other department like IRD one of the most deserving, who definitally deserve a rest. :o)

This law is mostly silly

This law is mostly silly because it will hurt one of new Zealands biggest assets.. whats that? you say... its New Zealands Isp's... people will all go back from their 10-20gig contracts to 1 gig this is over a 50% drop in what people pay for their internet.. this decreases their revenue and thus prevents and harms not only huge system upgrades but hundreds of jobs. This will not only happen as people will cut back but as peoples internet will not work, thus they will not be paying for it. Eventually destroying an internet society that makes its money of virtual illegality.

In a nut shell this is a pathetic law that ruins more lively hoods than it is 'attempting' to protect.

The government is so

The government is so dumb.
This will not just hurt us but will hurt many companies
and eventually no-one will have internet, then no more new shiny PC's in NZ and Millions of people could lose their jobs.

I personally make the download once in a while, But never have downloaded movies.
The government will end up regretting this decision.

...and they are doing this

...and they are doing this right when there is a recession?
This will make it worse

This idea really is stupid. I

This idea really is stupid.
I download music mostly but anyone telling me I am being disrespectful to the artists are unreasonable. I download maybe one or two songs by the artist, if I like what I have heard I go out and buy the album. Paying $10 for a new single is just ridiculous when you just want to give the band a try. Not only this but iTunes does not give any money to the musicians, it all goes to Apple. I have given Apple the money I owe them. I bought my iPod fair and square, charging me for the use of my iPod is just simply greedy. Not only that but other companies which supposedly give the money to the artists in fact give the money to Fat-Cat mainstream music companies. The whole thing is sick and simply results in theft of another sort.
It is as though it doesn't count as theft if a company is doing it. It is only theft if an ordinary person does it. Is this fair? No, it simply is not.

whats unfair on the ISP's is

whats unfair on the ISP's is that the have to "reasonably implement a policy that provides for termination, in appropriate circumstances, of the account with that internet service provider" so what is reasonable? who the hell knows? thats a lot of pressure on the ISP's to figure it out themselves. so no matter how they do it, the'll be damned if they do and damned if they dont. i download music, TV shows and software. but when it comes to music is that i have 7 days after i download the music to either buy the album or delete the files. how does my ISP know if i've done that??! they dont unless they are doing some illegal viewing of my computer files. when it comes to the shos i download. they are all free to air. so then im not making any company loose money. i just cant wait for my fix thats all! and besides, i bought the last season i downloaded on blu-ray many months after i downloaded it. then that becomes legal doesnt it? yes it does. but in that time i could have been shut off from my internet for 'illegal' downloading. and when it comes to the software i download, i only download programs that i cant afford lake the adobe suite. if i couldnt download it then i would not buy it. thats for sure. so those companies arent loosing any money from me! and movies. well. this is another touchy subject. my question is. if i download a movie because it doesnt come out in cinemas by me for a long time then go see it when it does come out. im paying my money to that film company anyways. but this could happen MONTHS after i downloaded the movie and have since been shut off for my 'illegal' downloading. this law makes no sense and has been poorly thought out by people whom obviously dont know anything about this sort of stuff.

7 days to buy the music?

7 days to buy the music? Where'd you get that licence from?

As for movies, no, buying it on bluray later does not make your downloading it earlier suddenly "legal".

Did anyone think about Lan

the next thing you know your not going to be allowed to youtube or Google "no matter what you do on the net your always Downloading a Cashe

Must... resist... urge...

Must... resist... urge... to.. correct... spelling... and... grammar...

I agree, this is a stupid

I agree, this is a stupid law. I use my internet loads! I use it for playing on xbox live, downloading FREE demos from xbox live, software updates for itunes etc, i use youtube and other free video watching websites. My dad uses about 1 gig himself, so when it comes down to it we use around 6 gig a month and we're on a 20gig plan.

The government can easily shut me down because this may be 'suspicious' because i use alot for one month, even though it is all truely legal. This is simply an unfair law to legal downloaders, plus the government will never be able to actualy stop downloading because the rest of the world is also doing it.

I dont need to make the points about shortening bandwidths and loss of buisinesses etc, but what i will say is that, originally the internet was made for porn, thats the bottom line, so now businesses in other countries such as america who make videos such as these will lose precious customers.

Basically no one can stop the internet, the only thing anyone can do really is let it role, because the government will never look at what a person is actualy downloading because that is a breach of privacy and is also against the law, if they find something, thats different, but only slightly.

This was actualy a law stolen from france anyway, the government should stop attacking its source of income and start thinking about more important things like its economy, this is only going to make it worse. The government is like a teenage girl, getting herself into a difficult situation when they have better things to worry about, and only making their life harder than it normally is. Government, hurry up and hit puberty because this is really pathetic.

everyone basically gets the

everyone basically gets the net to download............point blank

Well, that is how it works,

Well, that is how it works, you know. Web pages download to your system so you can view them. Emails download from the server so you can read them. If you're saying "everybody gets the net to download illegal content", then no. No, we don't. It's just the content companies that think we must. Because they don't understand what it is that we do do online, and that's why they're failing.

i used to download heaps.

i used to download heaps. this was all foreign videos or music which i can't get here.

Yeah, I download all the

Yeah, I download all the time, mainly because my music taste is... different... to every one elses I know and I cant find the bands cd's anywhere else, NOT EVEN GOOD OL' JB HI FI! And if I could find it there I have no where else to hear the music first for a tester so if I just bought the cd without hearing of any of the songs, I might be extremly disapointed, So I like to download one or two songs so then I have an idea of the cd's content first. The government is now killing my one love! Not saving it! PUCK YOU JOHN KEY!

Same here. I download things

Same here. I download things but only because it is music/shows that aren't in new zealand. Been in quite a bit of foreign shops too but still can't seem to find them their either T_T

First of all this "law" is

First of all this "law" is crap. If it wasn't for illegally downloading music half of New Zealand bands wouldn't be heard of. Sure they may have a couple thousand songs downloaded that they don't get paid for but those thousand songs they gain rep, gaining rep gains sales of full albums that the honest people of the world buy. In the end they're going to get more money for the albums then they lose from the songs illegally downloaded.

The government is monitoring

The government is monitoring u all right now.
So u suposed to say good thngs about them.
I download alot of stuff and bust my 40gb plan every month, telecom even make money off the fact that i usually go over my prescribed. Most internet users in newzeland are signed up with telecom. Isnt telecom partly owned by the state.
They already making money of us, but as is the case with most things, enough is never enough.

So does your favourite artist care that you downloading there music, hell no. they rich enough and are happy that at least someone likes them.

Certain senisitive information can be removed from Youtube and even some torrent sites.

This is doable, if its not been done its cos no1 cares

So was it actually enforced

So was it actually enforced on the 27th March 2009??? Darn it i have half a movie waiting to download LOL! Someone let me know!

I will purchase an album if

I will purchase an album if its worth the 30 bucks other then that nah! I will download only the good songs lol...............

The law is stupid they don't

The law is stupid they don't even think about the citys what don't even have a music store e.g. Gisborne. We have the warehouse so if we want music whats not rap or rock we need to download or buy it when we travel.

they need to change law again

they need to change law again DOWNLOAD is not a crime but UPLOADING is
you need to ban the uploaders not the downloaders.
here in Holland i download 450GB a month from usenet servers i do not up load anything and its all legal.

I totally agree, they need to

I totally agree, they need to take out the sorce if anything, not the people that only download for personal use. I myself dont know anyone that downloads and sells the movies/cd's to other people either, and isn't this law meant to try and stop that also? If people want to do that, they will just go to places where there is public internet and continue doing it.

It's ridiculous. It's a law

It's ridiculous. It's a law made by people who don't understand the internet.
I think it will fall through. Weren't they going to disconnect peoples internet if they were caught dling illegally a few months back? That never happened. Half New Zealand's laws fall through before they are passed.
Where do you draw the line? Is it OK to watch music videos on YouTube? Yes? If so, then isn't it OK for me to download these videos from YouTube to save my bandwidth?
Personally, I don't download music and don't agree with the amount of music people download, but this isn't the way to solve it.
Even if it does pass, there will be relatively simple ways to get around it. It'll be mainly those people downloading from LimeWire that get caught, not so much FTP.
I just hope they don't bust me for downloading porn.

Yes this law is a load of

Yes this law is a load of poppy-cock to try and attempt to solve an apparent problem. All that is going to happen is make things worse. They really dont understand the internet if they are going to bring such a law in. And we dont need such a law. I am enraged by this law in fact.

Laws do not solve problems. They are mearly put into force because they dont know how to solve the problem, thus providing a sumwhat fix (err this law doesnt fix anything i know) to a sumwhat apparent problem.

this new legislation is way

this new legislation is way too vague:
"reasonably implement a policy that provides for termination, in appropriate circumstances, of the account with that internet service provider of a repeat infringer".
How will they know exactly if the music I download is Illegal? It could be from Itunes. It could be Public Domain Music. It could be Music that I own in Record or CD form and am simple backing up on my computer through downloading. the same goes for Movie Downloads too.
ISP's will simple not follow these laws, they will not prosecute their own customers for using the internet for what it was made for. it's all very backwards.

what about ps3 , some of the

what about ps3 , some of the content i d/l is the size of a movie . i pay for psn content . does this mean they will ban me for being legal , i also d/l linux .. now will i be doomed for d/l a legal free product , i guess wifi hacking will be more wide spread , i am atm scanning for open connections ..

you've just commented on a

you've just commented on a post that's more than a year old -- You can catchup on latest developments in copyright law over at http://creativefreedom.org.nz

I don't understand why you're concerned about the size of the files you download. nowhere in the legislation does it say "if someone downloads big files, disconnect them"...

The old, flawed law amounted to "if a copyright holder accuses someone, the ISP had better disconnect them to avoid liability". nothing about what size file.. heck, you might not have used your connection at all for 6 months, you only needed to be accused, not proven, of repeated copyright infringement.
